The Federal Government has just released a draft bill, proposing changes to anti-discrimination law to better protect people of faith. If passed in parliament, the proposed new changes would ban discrimination on the basis of faith in areas such as employment, housing and the use of services.
However, while these changes should be cautiously welcomed, they simply do not go far enough.
In fact, after consulting with religious leaders, NSW Senator Concetta Fierravanti-Wells told The Australian yesterday that the bill falls “far short of properly and fully addressing their requirements for religious freedom protection”.
If our key freedoms, including the rights of parents, are to be protected in the long term, the Government must positively legislate and protect religious freedom as a “universal human right”. In short, the rights of Australians of faith should be enshrined through a “Religious Freedom Act” rather simply as another anti-discrimination exemption.

在五月的大选前,我们曾经警告过，工党打算在全国范围内引入“安全学校”类型的项目的意图。除此之外，工党在去年更提出了另一项政策：剥夺有宗教信仰背景的学校的只雇用尊重本校价值观和教义精神的员工的权利。这项政策明目张胆地侵犯了成千上万为孩子选择有宗教信仰背景学校的家庭的权利。
选举之后，很多工党高层都承认，工党需要更多地表达对信仰者权利的尊重。
几名工党前排议员更承认，信仰是影响五月份选举结果的关键因素，特别是在诸如西悉尼的多元文化地区，有信仰的人纷纷转身反对工党。
另外，工党的一名资深前排议员更指出一些宗教学校和慈善机构十分担心他们会因为教导一男一女的婚姻关系而失去政府的拨款。
Background
Before the May election this year, we warned that Labor’s intention was to introduce a “Safe Schools” type program nationwide. In addition, Labor had put forward a policy last year to strip faith-based schools of their right to only hire staff who respect the school’s values and ethos, a clear attack on the rights of hundreds of thousands of families who choose faith-based schools for their children.
Since the election, many senior figures in the Labor Party have acknowledged that Labor needed to show more respect to the rights of people of faith.
In fact, several Labor frontbenchers has since claimed that religious freedom played a key role in the May election result, saying people of faith turned against Labor, especially in multicultural areas such as Western Sydney.
Moreover, a senior Labor frontbencher has highlighted concerns among some religious schools and charities that they could lose funding because they were teaching a man-woman version of marriage.

It’s time for action
As you may remember, after the Ruddock report into religious freedom was eventually released last year, the Morrison Government promised to legislate positively to protect the rights of people and institutions of faith.
Friends, with some MPs on both sides of politics now calling for laws to protect religious freedom, there’s never been a better opportunity for this change to happen.
But not all MPs are convinced of this – and we need to let everyone in Canberra, from the Prime Minister down, know that we need clear action NOW!
We need to let all members of Parliament know our commitment to the importance of religious freedom. Rather than as a grudging exemption to current anti-discrimination laws, as is currently being proposed, we call for the Parliament to provide positive legislation to protect this important freedom in the form of a Religious Freedom Act.
